The federal bankruptcy process allows both individuals and businesses to eliminate or repay debts under the protection of the Federal Bankruptcy Court. A bankruptcy typically involves either liquidation or a reorganization. Filing bankruptcy generally stops most creditors from seeking to collect debts, and allows the debtor a chance to either discharge debts through liquidation, or submit a plan for repayment for the court to consider.
When the bankruptcy petition is filed with the Federal Bankruptcy Court, the filing triggers an order of protection in your favor, and automatically stays, or prohibits, all collection activities of creditors. Creditors are not allowed to commence or continue a lawsuit, repossess or foreclose on property, or contact you until further order of the court.
